What Industrial Companies Really Need to Prepare Before August 2, 2026

Many industrial companies are still waiting for standards, guidance, or more legal clarity. That is understandable - but operationally too late. This article shows what can and should already be prepared before August 2, 2026.

Why industrial companies should address this operationally now

In industrial AI, the temptation is to wait: for harmonized standards, for additional guidance, for more clarity from Brussels. That is understandable, but operationally risky. Under the current legal baseline, most AI Act rules apply from August 2, 2026, including the requirements for high-risk systems listed in Annex III. At the same time, the Commission has proposed in the Digital Omnibus context to link the application of certain high-risk rules to the availability of support tools such as standards and guidance.

The conclusion should not be: "Let's wait a bit longer." The right conclusion is: Build now what you will need regardless of standards.

Because even if technical standards add legal certainty, they do not solve the core implementation problem inside companies: poor visibility, unclear roles, weak documentation, and no reliable go-live process.

What is already clear today

For industrial companies, four points are already clear:

  • AI must be managed as an inventory, not as a loose collection of pilot projects.
  • Risk classification depends on the concrete use case, not on a tool's marketing label.
  • Production systems need traceable documentation, accountable roles, and an evidence chain.
  • Incident management, monitoring, and reassessment are not afterthoughts; they are part of the operating model.

In addition, the Commission is preparing further 2026 guidance on high-risk classification, transparency duties, serious incident reporting, and the obligations of providers and deployers. Companies that want to apply that guidance later still need a governance structure first.

1. Build a complete AI inventory

The first bottleneck in industrial organizations is almost never legal interpretation. It is lack of visibility. In practice, companies often have:

  • centrally introduced AI tools,
  • local pilots in plants or business units,
  • embedded AI inside third-party software,
  • assistant and analytics features that are not even tracked internally as AI systems.

What needs to be prepared is an inventory that at least captures purpose, deployment area, vendor, data context, affected user groups, responsible people, interfaces, and operating status. Without that baseline, every later risk review becomes guesswork.

2. Clarify the regulatory role of each system

Industrial setups rarely involve just one actor. Manufacturers, OEMs, integrators, platform vendors, internal data teams, and on-site operators are often intertwined. That is why each system should be mapped before August 2026 with clear answers to questions such as:

  • Who is the provider?
  • Who is the deployer?
  • Who modifies a system substantially enough to trigger additional obligations?
  • Who owns incident and change processes during operation?

This role clarity matters for contracts, audits, and day-to-day operations. Without it, the gaps that appear later are exactly the ones neither Legal nor Engineering can close quickly.

3. Assess high risk by use case, not by label

Many companies assess "the AI platform" or "the copilots in the plant" as a whole. That is the wrong approach. The AI Act does not primarily regulate labels; it regulates actual contexts of use.

An assistant for maintenance documentation is different from a system that evaluates worker performance, prioritizes access, or supports safety-critical decisions. Companies should therefore prepare a repeatable classification process with documented criteria, assumptions, and review points.

Those who structure that process now will be able to apply later Commission guidance to real systems much faster and with less friction.

4. Treat documentation as an evidence package

Industrial companies should not treat documentation as a set of fields to fill in. For production use, they need an evidence package that fits together. Typical building blocks include:

  • intended purpose and limits of use,
  • data sources and governance controls,
  • testing and validation results,
  • the human oversight model,
  • logging and traceability design,
  • monitoring and reassessment logic,
  • user and operational instructions.

The key point is not just that these elements exist. They need versioning, approval, and exportability. That is where many pilots fail during the transition to live operation.

5. Define a real go-live gate

In many industrial organizations, there is no binding release point between pilot and production. The result is predictable: technically the system is live, but Compliance, Security, Engineering, and Operations are all working with different assumptions.

What should be prepared is a simple but strict gate process:

  • name the owner,
  • define reviewers and approvers,
  • list required evidence,
  • make open findings visible,
  • allow go-live only when minimum conditions are met.

This may look organizational. In reality, it is the point where AI stops being treated as an isolated pilot and starts being managed as an operating system.

6. Lock down the incident and reassessment flow before the first problem

Another common mistake is to take monitoring and incident processes seriously only after something has already gone wrong. In industrial AI, that is too late. Especially where systems influence processes, quality assurance, or production-adjacent decisions, companies need clear rules up front:

  • What counts as an incident?
  • Who assesses severity and impact?
  • When is reassessment triggered?
  • How are changes, findings, and approvals documented?

Even while detailed serious-incident guidance is still evolving, the internal operational workflow can and should already be defined.

Why "we are waiting for standards" is strategically too weak

Harmonized standards will matter. They will create legal certainty and simplify implementation. But they do not replace an operating model. No standard will retroactively build your AI inventory, assign accountability, or structure your approvals.

Companies that wait for every last regulatory detail do not reduce work; they compress risk. Inventory, classification, documentation, governance, and incident logic then all need to be built under time pressure.

A pragmatic 90-day plan

  1. Weeks 1-3: Capture all production and planned AI systems in one place.
  2. Weeks 4-6: Define the role model and first risk classification per system.
  3. Weeks 7-9: Surface documentation and evidence gaps and assign owners.
  4. Weeks 10-12: Define go-live gates, incident flows, and reassessment triggers.

This is not a full compliance program. But it is exactly the preparation industrial organizations need now if they want to avoid turning regulatory uncertainty into operational paralysis.

Conclusion

Industrial companies do not need to wait for every final detail before August 2, 2026. They need to make their AI operating model defensible. Companies that build inventory, roles, risk logic, evidence, and go-live gates now will not only reduce regulatory risk; they will also move from pilot to production faster.
